スタイレックエンタープライズという会社が3ヶ月間の業務停止をくらった事件。この業界で3ヶ月というのは、それほど重い罰ではない。内容を見てみると、業務停止の理由は主に勧誘の方法に関するものであり、ビジネスモデル自体の問題を指摘するものではないようだ。

スタイレックエンタープライズはいわゆる投資型MLMのようなモデルであり、必ずしもネズミ講、すなわち無限連鎖講に該当するものではない。（線引きが微妙なところであるが。）

以下は経済産業省の発表資料の抜粋：
経済産業省は、連鎖販売業者である株式会社スタイレックエンタープライズ（本社：
東京都江東区）に対し、特定商取引法違反行為を認定し、同法第３９条第１項の規定に
基づき、本年４月１１日から７月１０日までの３か月間、同社の連鎖販売に関する新規
の勧誘、申込み受付及び契約締結に係る業務を停止するよう命じました。
また、併せて同法第３８条第１項の規定に基づき、同社に対し、業務停止期間中はそ
の連鎖販売契約の全部又は一部の譲渡又は貸与を行わないこと、並びに、違反と認定し
た不実告知と利益が確実と誤解させる断定的判断の提供の３項目について、それらが特
定商取引法に違反することである旨を同社の勧誘者等に通知することを指示しました。
認定した違反行為は、勧誘目的等不明示、不実告知、目的を告げずに公衆の出入りす
る場所以外の場所における勧誘、利益が確実と誤解させる断定的判断の提供です

また、以下は本件に関する朝日新聞の記事である。

利益が出るかどうか確実ではないのに「地球環境によくて必ずもうかる」などと言って会員を募っていたとして、経済産業省は１０日、植林事業などのマルチ商法を行う「スタイレックエンタープライズ」（東京都江東区）に対し、特定商取引法違反（不実の告知など）で１１日から３カ月間の業務停止を命じた。

　同社は顧客の自宅や、公民館などに人を集め、「１０人紹介すれば、ランクが上がって収入が増える」「契約すると、数百万円、億単位のお金が入ってくる」などと顧客を勧誘していた。

日本の年金制度は最大級のネズミ講であると気がつき始めている人が増えている。犯罪もあまりにも大規模だと気が付かない。先日起こった元ナスダック会長によるネズミ講事件も同じだ。以下関連記事の抜粋。他にも「年金　ネズミ講」で検索すると様々な意見が見つかる。

「1人殺すのは犯罪者だが、100万人殺せば英雄になる」といったのはチャプリンだが、ネズミ講も数億円だと犯罪になるが、1000兆円になると国民に堂々と発表できるようだ。先週、政府の経済財政諮問会議に出された「骨太の方針」の素案では、基礎的財政収支（プライマリーバランス）を2011年に黒字化する方針を放棄し、2020年ごろに黒字化するには消費税を12％に引き上げる必要があるという試算を公表した。これはバラマキ補正予算で発行する巨額の国債を、子孫の税金で償還しようというネズミ講だ。

　書けば書くほど腹が立ってくるが、首相官邸のＨＰを眺めていたら、「小泉内閣メールマガジン第１２９号（１月２９日付）」の[編集後記]にこんな戯言が書いてあるのを発見して、またもや怒りがこみ上げてきた。

　これじつは、ネズミ講の論理なのである。

2009年7月22日、警視庁が、出資法違反の疑いで、東京・墨田区の「ライフ・アップ」本社に強制捜査に入った。

ライフアップは健康食品を毎月購入すると、毎月年金型の報酬が支払いがもらえるといううたい文句で会員を集めていた。通常のネズミ講は商品が介在しないため、すぐに非合法であると誰もがわかるが、ライフアップの場合は一応、商品が流通しているため、あまり知識がない人だともしかしたらありうる話かも、と思ってしまうのかも知れない。

ライフアップの穴は、新規会員が増えなくても報酬が入り続けるという点だ。これはどう考えてもおかしな話。報酬の原資がないのに、報酬が支払われるわけがない。

ちなみにライフアップで検索すると、同じ社名の会社が多数。とんだ迷惑を被っていることだろう。

東京都墨田区の健康食品販売会社「ライフ・アップ」（田沢吉美社長）が、「健康食品を購入すれば、ボーナスが入る」と勧誘し、不特定多数の会員から資金を集めていた疑いがあるとして、警視庁は２２日午後、出資法違反容疑（預かり金の禁止）で、本社事務所など数カ所を家宅捜索する方針を固めた。同社は「年金たまご」と呼ばれるシステムを使い、約３年間で全国から少なくとも数十億円を集めたとみられる。

　同社は平成元年５月に設立され、１８年１０月ごろから、「年金たまご」を使った資金集めを始めたとみられる。関係者によると、「年金たまご」は「年金型ボーナスシステム」で、月１万３５００円を支払い、ブルーベリーやコラーゲンなどの健康食品を購入すると、１年目は１３万２千円、２年目は約２８０万円のボーナスを受け取ることができると宣伝していた。

　この仕組みについて、同社は「加入すると、会社が自動的に配置した子会員や孫会員の出資金の中から、ボーナスを配当する」「自分で会員を紹介しなくてもボーナスがもらえる」などと説明していたという。

　しかし、昨年から「ボーナスの支払いが滞っている」「解約できない」といった苦情が、弁護士事務所などに寄せられていたという。

日本でも有名になったねずみ講事件です。

一見、テクノロジー系のマルチ商法ですが、日本においては特定商取引法に違反しているなど、問題が多かった。こういったテクノロジー系のビジネスは、その方面に詳しくない素人をターゲットにして、違法ではないものの、とても妥当とはいえないビジネスモデルを作り上げている場合がほとんどなので、注意が必要だ。

スカイビズ事件の概要：
2001年にアメリカ合衆国オクラホマ州のスカイビズ社が、ウェブサイト1年間開設権付きウェブサイト作成ソフトウェアの代金110ドルで会員を募集、開設したウェブサイトへ人を集めさせ、ミーティングへ呼んで入会者が特定数出る毎にキャッシュバックを支払い、多く集める程キャッシュバックが高額に成るとしていた。

解約は72時間以内とするクーリングオフ制度を無視（日本の特定商取引法の規定では20日）した契約などの問題点も多く、2003年にスカイビズ社が経営破綻に陥り、各会員は下位会員を募集するために購入したウェブサイト作成ソフトウェアの代金分や、自分の募集する予定の加入者の会員加入金として予め振り込んだ分だけ余計に損をした事になる。

破綻後、米国連邦取引委員会（FTC）が介入して2000万ドルを回収し、債権者への分配を行うなどして対応している。

2009年3月に世界を席巻した巨額詐欺事件のニュース。これは元ナスダック会長が引き起こしたものである。

一般的には詐欺事件とされているが、仕組みとしてはネズミ講とまったく変わらないものだ。実態ビジネスがなく、次から次へと出資者を募らなければいずれ破綻するというモデルだ。
